1. Acceptance of Terms

By accessing or using Frag Finders, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use the Site.

2. Who We Are

Frag Finders is an online marketplace for the reef aquarium hobby in the UK, allowing users to buy, sell, exchange and explore the aquarium hobby from fish, plants, corals, macroalgae, invertebrates, and equipment.

3. User Accounts

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your account access credentials.
• Frag Finders reserves the right to suspend or terminate accounts that violate these Terms.

4. Listings & Transactions

• Users are responsible for the accuracy and legality of their listings.
• Frag Finders does not guarantee and makes no representation about the quality, safety, or legality of listed items.
• All transactions are performed directly between the vendor and the buyer. Frag Finders facilitates those transactions, but is not a party to them.
• Frag Finders will attempt to resolve disputes between buyers and sellers where possible.

5. Vendor Subscriptions

Subscription fees and other payments to Frag Finders are non-refundable. Frag Finders reserves the right to change pricing and features at its sole discretion.
Frag Finders takes a 2% service fee on each listing transaction through the platform. This is added to the buyer’s fee. This fee ensures the website’s continued maintenance and provides the buyer with buyer’s protection.

6. Prohibited Activities

Users agree not to:

• List or sell illegal, endangered, or prohibited species.
• Post misleading information or fraudulent listings.
• Use the Site for spamming, harassment, or illegal activities.
• Attempt to hack, scrape, engage in unfair competition or otherwise misuse Frag Finders.

7. Content & Intellectual Property

• Users retain rights to their uploaded content but grant Frag Finders a license to display it, as well as use it in its own marketing materials.
• Frag Finders branding, trademarks, and content may not be copied or used without written permission.

8. Limitation of Liability

Frag Finders is not liable for:

• Losses, damages, or any other financial and non-financial issues arising from transactions between users.
• Errors, interruptions, or security breaches of the Site.
• Other losses or damages resulting from issues beyond Frag Finder’s control – including but not limited to force majeure, acts of God, fires, pandemics, industrial action, changes in legislation and regulation, taxes etc.
• Items that have been sold on collection or listed as collection only. Frag Finders cannot take responsibility for collected items.

9. Dispute Resolution & Refunds

• Frag Finders will attempt to resolve disputes between buyers and sellers.
• Frag Finders strongly recommends that sellers ship with signed-for tracking and delivery. In cases of dispute, Frag Finders will request proof of delivery in its assessment.
• Sellers must mark the item as delivered to update the system and and trigger payment by requesting payout on the account dashboard.
• Buyers have 2 days from the marked delivery date to request a refund for dry goods.
• Frag Finders will offer buyers partial or full refund of the cost of the item if the product can be proven damaged or not delivered.

10. Live Arrival Guarantee

For live or perishable items (e.g., corals, fish, invertebrates), buyers and sellers must follow the Live Arrival Guarantee policy:

1. Seller Responsibilities:
   • Sellers must properly pack and ship live items using appropriate materials and insulation.
   • It is strongly recommended that sellers use next-day delivery with tracking and “signed-for” shipping.
   • Sellers must clearly state their Live Arrival Guarantee terms in the listing (e.g., coverage duration, refund or replacement policies).
2. Buyer Responsibilities:
   • Buyers must be available to receive the package on the first delivery attempt.
   • If an item arrives dead on arrival (DOA), buyers must report the issue to the seller within 2 hours of delivery with clear photographic evidence.
   • Failure to follow these steps may result in the claim being denied.
3. Dispute Resolution:
   • If the buyer and seller cannot reach a resolution, Frag Finders will assess the case based on provided proof (e.g., photos, shipping details).
   • Frag Finders reserves the right to issue a partial or full refund or deny claims if policies are not followed.

11. Privacy Policy

By using Frag Finders, you agree to our Privacy Policy, which outlines how we collect and use your data.

12. Amendments to Terms

Frag Finders may update these Terms & Conditions at any time. Users are responsible for checking the Terms & conditions displayed on the website and acting accordingly. Continued use of the Site after updates constitutes acceptance of the new terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Unless agreed otherwise in writing, any dispute is under the sole jurisdiction of English court of law.
